Welcome to Zyliathor. These Terms of Service govern your use of our website and purchases from our store. In these Terms, “Zyliathor,” “we,” “us,” and “our” refer to the seller operating this store, whose business details are provided in our Legal Notice and your order documentation.

Please read these Terms together with our Shipping Policy, Return & Refund Policy, applicable warranty terms, and Privacy Policy before placing an order.

Nothing in these Terms excludes or restricts consumer rights or liabilities that cannot lawfully be excluded or restricted.

1. General Terms

We supply off-road go-karts, electric and gas-powered go-karts, replacement parts, and related products and accessories.

You must be legally capable of entering into a purchase contract. When placing an order, you must provide accurate contact, billing, and delivery information and be authorized to use the selected payment method.

Purchasing a product for a younger rider does not mean that every model is suitable for that rider. Product-specific age, height, weight, and supervision requirements must be followed.

2. Product Information and Specifications

We aim to provide accurate product descriptions, specifications, images, prices, and availability information.

Performance figures, including speed, range, and charging time, are estimates under specified conditions. Actual results may vary with rider weight, terrain, weather, battery condition, maintenance, and riding style.

We may update products and listings for future orders. Products supplied for an existing order must conform to the description and specifications agreed upon when the purchase was made.

If a material change would affect your order’s performance, functionality, compatibility, or included equipment, we will notify you before fulfillment and seek your agreement. If you do not agree, we will offer an appropriate alternative or cancellation with a refund for the affected items and associated charges.

Nothing in this section limits your rights if a product is defective or does not match its description.

3. Prices and Payment

Prices are displayed in the currency identified on the product page and at checkout. Please review the final currency, item prices, shipping charges, and any taxes or duties shown before paying.

Payment must be successfully completed before an order can be processed.

Price changes apply to future orders. We will not increase the agreed price of an existing order without your express agreement.

If we identify a material pricing or availability error affecting your order, we will contact you to explain it and discuss the available options. We will not charge an additional amount without your consent. If we cannot fulfill the order and cancel it, we will refund the amounts paid for the canceled portion without a cancellation fee.

4. Order Processing

Order preparation generally takes 3–15 business days, depending on the model, configuration, and warehouse availability. A different preparation period may be stated for a particular product before purchase.

Products already stocked in the destination country may require less preparation time. Custom orders may require longer preparation, which will be communicated before purchase.

Preparation time is separate from shipping transit time. Business days exclude weekends and applicable public holidays.

If we cannot ship within the promised period, we will notify you, provide an updated estimate where available, and explain your options to agree to the delay or cancel for a full refund of the affected unshipped order, as required by applicable law. Where consent to a delay is required, we will obtain it.

5. Shipping and Delivery

Delivery availability depends on the destination, selected model, and current inventory.

The following are estimated transit times after shipment, excluding order preparation:

Shipping charges are calculated and displayed at checkout. Any duties and taxes collected through checkout are shown before payment. If import charges are not specified, please contact us before ordering to confirm the arrangements for your destination.

Oversized products may arrive in multiple packages. Batteries and certain components may ship separately and arrive on different dates. Tracking information will be provided as it becomes available.

Delivery estimates may be affected by customs processing, weather, and carrier schedules. These estimates do not remove our obligations concerning delivery, delay notifications, refunds, or other statutory remedies.

Please contact us promptly if a shipment appears lost, damaged, or significantly delayed so we can investigate and arrange an appropriate solution.

6. Order Cancellations

Please contact us as soon as possible if you want to cancel or change an order.

Voluntary cancellation requests

For standard orders, our voluntary cancellation request window is 24 hours after placing the order, provided production or fulfillment has not started.

After that period, or once production or fulfillment has begun, we may be unable to accept a voluntary cancellation. If the order has shipped, return options are governed by our Return & Refund Policy and applicable law.

Custom or personalized orders may have additional cancellation restrictions disclosed before purchase. Describing an item as a “special order,” or beginning standard fulfillment, does not by itself remove statutory cancellation or withdrawal rights.

Cancellation fees

Where legally permitted and disclosed before purchase, an approved voluntary cancellation may be subject to a 10% processing fee, calculated on the discounted price paid for the canceled items, excluding shipping and taxes.

Any fee must be reasonable, proportionate, and consistent with applicable law. We will reduce or waive it where required. It is not a statement that payment providers charge a standard 10% transaction fee.

This fee does not apply to:

• Statutory withdrawals or other cancellations for which the law prohibits a fee.

• Orders we cancel because we cannot supply the products.

• Cancellations arising from our failure to meet a binding obligation where a full refund is required.

• Refunds or remedies required by law for defective, damaged, incorrect, or misdescribed products.

Refund timing

Approved cancellation refunds will normally be issued to the original payment method within 5–7 business days, subject to any earlier legal deadline. Your payment provider may require additional time to display the refund.

A valid statutory withdrawal does not require our prior approval.

7. Returns, Exchanges, and Product Problems

Our voluntary change-of-mind return policy requires you to contact us within 14 days of delivery. Items must be unused, unassembled, and in their original packaging, with all parts, accessories, and manuals included.

For eligible voluntary returns:

• Contact us for return instructions and the correct return address before shipping.

• Return shipping is paid by the customer unless applicable law requires otherwise.

• No return processing or restocking fee applies.

• Original shipping charges are not refundable unless required by law.

• Follow the return shipment and refund procedures in our Return & Refund Policy.

These conditions do not restrict statutory withdrawal rights or remedies for damaged, defective, incorrect, or misdescribed goods. Such claims are assessed separately from change-of-mind returns.

Exchanges depend on availability and any agreed price difference or shipping arrangements.

8. Statutory Consumer Rights and Warranties

Where EU statutory withdrawal rights apply, you may generally withdraw from an eligible online purchase by notifying us within 14 days of delivery, without giving a reason.

For eligible statutory withdrawals, no cancellation or restocking fee applies, and standard outbound delivery charges are refundable as required by law. The applicable statutory return and refund periods take precedence over shorter periods in our voluntary policies.

Necessary inspection does not automatically remove a withdrawal right. Legally permitted deductions for diminished value may apply. Genuinely personalized goods may qualify for a statutory exception.

Consumer guarantees, remedies for defective goods, and other mandatory protections under applicable law remain unaffected.

Any commercial warranty we offer is additional to these rights. The end of a commercial warranty period does not automatically end rights available under consumer protection law.

9. Product Use and Safety

Our go-karts are intended for appropriate private-property and off-road recreational use. They are not sold as street-legal vehicles and must not be used on public roads, highways, sidewalks, or other prohibited areas.

Before use, read and follow the product manual, assembly instructions, safety warnings, and model-specific operating limits.

Riders must:

• Meet the model’s age, height, and weight requirements.

• Wear a properly fitted helmet and suitable protective equipment.

• Use the restraints and safety equipment supplied with the model.

• Complete the required assembly and pre-ride checks.

• Use terrain and operating conditions suitable for the product.

• Avoid public traffic, standing water, unsafe terrain, and prohibited activities.

• Follow applicable local laws and supervision requirements.

Adult supervision does not make a product suitable for a rider who does not meet its requirements.

Stop using the product and contact us if you identify a safety-related fault.

10. Responsibility and Liability

Customers are responsible for following the supplied instructions and using products safely.

To the extent permitted by applicable law, we are not responsible for loss or damage to the extent it is caused by misuse, failure to follow appropriate assembly or maintenance instructions, unauthorized modifications, or operation outside the product’s stated limits.

This does not exclude responsibility for defective products, inadequate instructions, our own acts or omissions, or any other liability that cannot lawfully be excluded or limited.

Nothing in these Terms excludes or limits non-excludable liability for death or personal injury, fraud, or mandatory consumer guarantees and remedies. Responsibility will be assessed according to the circumstances and applicable law.

11. Privacy

Our Privacy Policy explains how we collect, use, and handle personal information when you visit our website, place an order, or contact us.

Please provide only the information reasonably needed for your inquiry. Do not send payment-card details or passwords by email or WhatsApp.

12. Policy Updates and Interpretation

We may update these Terms for future purchases. Updates will be posted on this page with a revised date.

Updates will not retrospectively remove rights or change the agreed terms of an existing purchase without a valid legal basis or your agreement.

Our policies should be read consistently. A specific commitment agreed for your order is not withdrawn by a general statement elsewhere on the website. Mandatory consumer law takes precedence over any conflicting policy provision.

If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
